Understanding DUI Law in Ohio

In Ohio, operating a vehicle under the influence of alcohol or drugs can result in an OVI charge, the equivalent of a DUI in other states. Most drivers are considered legally intoxicated if their blood alcohol content exceeds 0.08 percent. However, that limit is lower for drivers under the age of 21 (0.02 percent BAC will result in an OVUAC charge) and commercial vehicle drivers (0.04 percent BAC will result in an OVI charge).

What Are the Penalties for OVI or OVUAC?

The penalties for an intoxicated driving charge depend on several factors, including previous drunk driving charges, a criminal background and injuries to others. The first OVI charge can result in $1,075 in fines, three years of license suspension, court-ordered drug and alcohol treatment, six months in jail and an ignition interlock device on your vehicle.

A second charge can result in up to $1,625 in fines, a seven-year license suspension and a 90-day vehicle immobilization, along with jail time and community service. A third charge can result in up to $2,750 in fines, 12 years of license suspension, jail time and required drug and alcohol treatment.

Other factors lead to harsher penalties. If someone is injured in a crash caused by an intoxicated driver or if a driver has a BAC of 0.17 percent or greater, the fines and punishments will be even more severe.
