Have you been charged with a DUI in West Chester or another Cincinnati suburb? If so, ask yourself the following five questions:

  • Would you like to be represented by an experienced West Chester DUI lawyer instead of a lawyer who handles just a few DUI cases every year?
  • Do you want your West Chester DUI lawyer to be recognized by lawyer advocacy groups like Super Lawyers, National Advocacy for DUI Defense, the National Trial Lawyers, and the American Society of Legal Advocates?
  • Would you prefer a West Chester DUI lawyer who concentrates his practice primarily on DUI defense instead of a part-time DUI lawyer who also handles cases in personal injury, estate planning, probate, domestic relations, and child custody?
  • Would you like your West Chester DUI lawyer to limit the number of cases he accepts so that he can ensure your case gets the time and attention that it deserves?
  • Do you want to be represented by a West Chester DUI lawyer who has a history of getting the majority of charges against his clients dismissed/reduced?

If you answered yes to those questions, please continue reading. Jeremiah Denslow is an experienced West Chester DUI lawyer who represents DUI clients in Butler, Warren, Hamilton, and Clermont Counties. Jeremiah structures his West Chester DUI defense practice using a very simple formula: (a) a focus and dedication to DUI defense; (b) a focus and dedication to Ohio courts; and (c) a focus and dedication to limiting the number of clients he accepts. Jeremiah’s practice is focused on DUI defense and he accepts fewer clients than most other West Chester DUI lawyers. That means each client gets more attention and each case gets analyzed more thoroughly. It also means there is constant communication between Jeremiah and his clients.

If you’re charged with a West Chester DUI, you might be wondering what that means.

Of course, you know that it means something about drinking, but let’s look at the charges a little more closely. There are two primary ways that law enforcement brings West Chester DUI charges against a defendant:

  • If you’ve been charged with a West Chester DUI under the “pro se” statute, that means the law enforcement agency in your case claims that you were driving a vehicle with a blood alcohol concentration (BAC) of 0.08% or greater. In virtually all pro se cases, the DUI driver agreed to take the breath test and tested over the legal limit.
  • On the other hand, if you’ve been charged with a West Chester DUI under the general prohibition against drinking and driving, the police claim that you were driving a vehicle while “under the influence” of alcohol. In this type of West Chester DUI violation, the police are not required to prove a particular blood alcohol concentration. Rather they are simply saying you were under the influence. So what does “under the influence” mean?  West Chester DUI regulations state that a person is under the influence when he consumes alcohol or drugs in such a quantity, whether small or great, that it adversely affects and appreciably impairs his actions, reactions, conduct, movements or mental processes so as to deprive him of that clearness of mind and control of himself which he would otherwise have possessed, and it impairs to any appreciable degree his ability to operate a vehicle.

A Good West Chester DUI Lawyer Can Utilize the Following DUI Defense Strategies:

  • The first thing a West Chester DUI lawyer would evaluate:  Did the police officer have sound legal reasoning for stopping the vehicle at the beginning of the West Chester DUI investigation?
  • The second issue a West Chester DUI lawyer might evaluate: Did the police officer have justifiable reason to expand the traffic stop to a DUI investigation?
  • A third factor every good West Chester DUI lawyer examines: Did the police officer substantially comply with the West Chester DUI regulations for administering field sobriety testing?
  • A fourth issue that a West Chester DUI lawyer should consider: In cases where the driver submits a breath, blood or urine sample, did the police officer substantially comply with all West Chester DUI regulations in obtaining the sample?
  • Yet a fifth item that top West Chester DUI lawyers examine: Did law enforcement inform the West Chester DUI driver of the Miranda warnings before questioning him about alcohol consumption.

These are just a few of the issues a good West Chester DUI lawyer evaluates when analyzing a West Chester DUI case. For a much more comprehensive list, please review the information on my site dedicated to DUI defense strategies.

What Are the Penalties for a West Chester DUI?

In West Chester Ohio, DUI is considered a serious charge that carries serious penalties. How serious?  First and maybe most intimidating, a West Chester DUI carries mandatory jail time up to a maximum of 180 days, even for a driver’s first DUI offense. It also carries a mandatory Ohio license suspension anywhere from six months up to three years and a mandatory fine up to $1075 as well as other financial penalties. West Chester DUI courts can require a DUI driver to complete a chemical dependency program, including in-patient or residential treatment. In addition, West Chester DUI courts have the power to install special DUI license plates onto your vehicle and an ignition interlock device onto your car’s ignition system. This device forces you to provide an alcohol-free breath sample every time you start your car.

Again, these are among the potential penalties for first time West Chester DUI cases. For individuals who have one or more prior drinking and driving convictions, the penalties are much more serious—more mandatory jail time, higher fines, and much longer license suspensions. For a felony DUI in West Chester, Ohio, DUI drivers can be sentenced to a prison term with the Ohio Department of Rehabilitation and Correction. Unfortunately, Ohio judges do not have the discretion to go below the mandatory minimum sentences in West Chester DUI cases.

However, anyone facing a West Chester DUI should realize that the penalties discussed above only apply to drivers who are convicted of DUI. An experienced West Chester DUI lawyer may be able to prevent that from happening. It’s not uncommon for a good West Chester DUI lawyer to get a DUI charge dismissed or reduced to a traffic violation given the facts and circumstances of the case. If you are facing DUI charges in Butler County or the surrounding areas, it’s important to contact a top West Chester DUI lawyer to see if he can get the case dismissed or reduced.
