If you’re facing a drinking and driving charge and searching for a Middletown DUI attorney, ask yourself the following questions:

  • Would you like to be represented by an experienced Middletown DUI attorney instead of a Middletown DUI attorney who handles just a few DUI cases every year?
  • Would you like to be represented by a Middletown DUI attorney who has a history of getting the majority of charges against his clients dismissed/reduced?
  • Would you like to be represented by a Middletown DUI attorney who has been recognized by lawyer advocacy groups like Super Lawyers, the National Trial Lawyers, the American Society of Legal Advocates and the National Advocacy for DUI Defense?
  • Would you prefer a Middletown DUI attorney who concentrates on DUI defense instead of a part-time Middletown DUI lawyer who also handles cases in personal injury, estate planning, probate, domestic relations, and child custody?
  • Would you like a Middletown DUI attorney who limits the number of cases he accepts each year so that you and your case get the time and attention you deserve?

For good reason, almost everyone answers yes to the aforementioned questions. If you’re in that group of respondents, you’re in the right place. Jeremiah Denslow is an experienced Middletown DUI attorney who represents DUI clients in Butler, Warren, Hamilton, and Montgomery Counties. Jeremiah structures his Middletown DUI defense practice using a very simple formula: (a) a concentrated focus on DUI defense; (b) a concentrated focus on Ohio courts; and (c) a concentrated focus on limiting the number of active clients. Jeremiah has learned that a focused DUI attorney generally knows the DUI laws better than an attorney who practices in numerous areas of law.  As such, Jeremiah’s practice is extremely focused on DUI defense and he accepts fewer clients than most other Cincinnati, Dayton and Middletown DUI attorneys. That means each client gets more attention and each case gets more attention as well. It also tends to promote active lines of communication between attorney and client.

Middletown Ohio DUI Law and Regulations

If you were arrested and cited for a Middletown DUI, you might be wondering what DUI or OVI means. Almost certainly you understand that the charges relate to drinking and driving, however, let’s look at the charges a little more closely. Police officers, sheriff’s deputies and Ohio state troopers can bring Middletown drinking and driving charges against a citizen in two different ways:

People charged with a Middletown DUI under the prohibited blood alcohol concentration section of the law are facing charges that say they were driving a vehicle with a blood alcohol concentration (BAC) of 0.08% or greater. In this particular section of the Middletown DUI statute, there is nothing that says the driver must be intoxicated, impaired or even slightly buzzed. A high breath test if a per se violation of the statute and lack of intoxication is not a defense.  In most of the Middletown DUI cases charged under this section of the statute, the DUI driver agreed to take a breath test and tested over the legal limit.
People charged with a Middletown DUI under the (A)(1)(a) section of the statute, which is the general prohibition against drinking and driving, are facing the charge of being drunk or impaired while driving.

In this particular section of the Middletown DUI statute, the law enforcement agency involved in the case is not required to prove a particular level of alcohol in a driver’s blood. Rather they are simply saying the Middletown driver was drunk or under the influence, regardless of the amount of alcohol consumed. So what does “under the influence” mean?  Middletown DUI regulations state that a person is under the influence of alcohol or drugs when he consumes them to the degree that the consumption adversely affects and noticeably impairs his actions, reactions, and mental processes so he does not possess the clearness of mind and control which he would otherwise have possessed. Under the influence would necessarily include the impairment to operate a motor vehicle to any appreciable degree.

In either case, top Middletown DUI attorneys have a number of tools at their disposal to get a drinking and driving case ready for trial and to further help get the case reduced or dismissed entirely. Following is a list of defense strategies a Middletown DUI lawyer should consider in every case.

Middletown Ohio DUI Attorney Basic Defense Strategies

A Middletown DUI attorney should first consider the following issue:  Did the police officer have reasonable suspicion or probable cause to stop the vehicle at the commencement of the Middletown DUI investigation? If the answer is no, the Middletown DUI attorney may be able to get the entire case dismissed.

If the answer is yes, a Middletown DUI attorney should next consider this issue:  Did the police officer have reasonable suspicion or probable cause to elevate the traffic stop to a DUI investigation? If the answer is no, a good Middletown DUI attorney may be able to get the case dismissed.

If the answer is again yes, a Middletown DUI attorney should next ask the following question: Did the police officer substantially comply with the Middletown DUI regulations for advising, demonstrating, administering and scoring the DUI field sobriety testing? If not, the Middletown DUI lawyer may be able to get the case dismissed or reduced to a lower offense.

If the officer complied with the rules governing field sobriety testing, the Middletown DUI attorney should next evaluate the following: In Middletown DUI cases where the driver agrees to take a breath test, did the police officer substantially comply with all Middletown DUI regulations in obtaining the sample and operating the equipment? If the officer did not, a knowledgeable Middletown DUI attorney may be able to get the case dismissed or reduced to a lower offense.

Another issue Middletown DUI attorneys should review: Did the police officer, sheriff deputy or Ohio trooper involved in the case advise the Middletown DUI suspect of his Miranda rights before asking him questions about drinking and driving? If the answer is no, a good Middletown DUI attorney may be able to get incriminating statements and confessions thrown out of evidence, thereby strengthening the chances of winning the Middletown DUI case at trial.

These are just a few points of analysis that a top Middletown DUI attorney would evaluate when reviewing a DUI case. It’s important to understand this is just the tip of the iceberg. There is much more analysis that goes into evaluating the strengths and weaknesses of a Middletown DUI case.

Middletown Ohio DUI Penalties and Consequences

In cases where the evidence seems solid and a plea bargain may be a good idea, top Middletown DUI attorneys can offer a substantial amount of assistance in working to mitigate the punishment. Drinking and driving in Ohio is considered a serious charge that carries serious consequences. How serious?  First and foremost, a Middletown DUI carries mandatory jail time up anywhere from 3 days to a maximum of 180 days, even for a first DUI offense. While jail time is mandatory, Ohio law allows the court to sentence a first time DUI offender to a three-day driver intervention program in lieu of jail time. A Middletown DUI attorney would certainly advocate this program for most, if not all, of his clients.  A Middletown DUI also carries an Ohio driver license suspension that can last for years and fines that run into the thousands of dollars, all depending upon the driver’s record.  Middletown DUI courts can require a DUI driver to complete a chemical dependency program, including a six-month in-patient program if the court feels it’s necessary. However, most of the time, drug and alcohol counseling is done on an out-patient basis and residential treatment is reserved for serious DUI offenses or repeat DUI offenders.

Again, these are among the possible penalties in Middletown DUI cases. For drivers who have bad driving records, especially prior DUIs, the penalties get more severe—more time in jail, more expensive fines, and much longer driver license suspensions. For a felony DUI in Middletown, the court has the ability to sentence a DUI driver to up to five years in prison and order them to pay financial sanctions in an amount exceeding $10,000.

If you’re currently charged with a Middletown DUI, please realize that the penalties referenced on this page only apply to drivers who are convicted of a Middletown DUI offense. A top Middletown DUI attorney may be able to prevent a conviction. It’s not uncommon for a good Middletown DUI attorney to get a DUI charge reduced to a lower level offense given the facts and circumstances of the case. However, you should realize that every case is different and the differences in the facts can make a huge difference in the outcome of the case. The same is true with Middletown DUI attorney. Different DUI lawyers produce different results. If you are facing DUI charges in Butler County, please take some time to contact a top Middletown DUI attorney to see what he or she can do.
