Middletown Ohio DUI Law and Regulations

If you were arrested and cited for a Middletown DUI, you might be wondering what DUI or OVI means. Almost certainly you understand that the charges relate to drinking and driving, however, let’s look at the charges a little more closely. Police officers, sheriff’s deputies and Ohio state troopers can bring Middletown drinking and driving charges against a citizen in two different ways:

People charged with a Middletown DUI under the prohibited blood alcohol concentration section of the law are facing charges that say they were driving a vehicle with a blood alcohol concentration (BAC) of 0.08% or greater. In this particular section of the Middletown DUI statute, there is nothing that says the driver must be intoxicated, impaired or even slightly buzzed. A high breath test if a per se violation of the statute and lack of intoxication is not a defense.  In most of the Middletown DUI cases charged under this section of the statute, the DUI driver agreed to take a breath test and tested over the legal limit.

Rather they are simply saying the Middletown driver was drunk or under the influence, regardless of the amount of alcohol consumed. So what does “under the influence” mean?  Middletown DUI regulations state that a person is under the influence of alcohol or drugs when he consumes them to the degree that the consumption adversely affects and noticeably impairs his actions, reactions, and mental processes so he does not possess the clearness of mind and control which he would otherwise have possessed. Under the influence would necessarily include the impairment to operate a motor vehicle to any appreciable degree.
