Any Mason DUI lawyer can tell you that operating a vehicle while under the influence of alcohol or drugs (OVI) and driving under the influence (DUI) are common phrases people use when talking about the law that prohibits drinking and driving in Mason Ohio. It is also sometimes called DWI, or driving while impaired. The law makes it illegal to drive a vehicle while generally impaired or drive a motor vehicle with a blood alcohol concentration (BAC) of over .0.07%, also called a “per se” Mason DUI. In addition, Mason DUI regulations prohibit a high tier drinking and driving charge, where a Mason DUI driver has a high blood alcohol concentration of over 0.16%.
In Mason and the rest of Ohio, DUI is considered a fairly serious charge that carries fairly serious penalties. How serious? A Mason DUI carries mandatory jail time—anywhere from three days up to six months, even for a first offense. It also carries a mandatory driver’s license suspension anywhere up to three years and a mandatory fine that can exceed $1000 but can be no less than $375. The Mason DUI Court will typically require a DUI defendant to take a drug/alcohol assessment and follow any recommendations from the assessment. That can mean a DUI defendant can be court ordered to attend a Mason DUI treatment program like weekly counseling or attendance at AA meetings. In addition, the Mason DUI court can force you to obtain special DUI license plates onto any vehicle you drive and require you to install a device on your car called an ignition interlock that will check your blood alcohol content every time you start your car. These devices can be expensive and require regular monitoring by the court.
