In addition, Hamilton Ohio has a high tier drinking and driving charge, aka super DUI, where a drunk driver tests at an elevated BAC concentration of above 0.17%.

In Hamilton, a DUI is considered a serious charge that can result in serious penalties if the driver is convicted. How serious?  For starters, a Hamilton DUI carries a mandatory jail sentence anywhere from three days to six months, even if it’s the offender’ s first conviction for drinking and driving. It also carries a mandatory Ohio license suspension anywhere from six months up to three years and a mandatory fine up to $1075 plus court costs.  In addition, Hamilton Ohio DUI courts can order DUI defendants to complete a substance abuse treatment program and place specially marked DUI license plates onto a defendant’s vehicle.  For Hamilton drinking and driving defendants with prior Ohio DUI convictions on their records, the penalties are much more severe—longer jail sentences, more expensive monetary fines, lengthier driver license suspensions and many ancillary consequences as well.  Unfortunately, Hamilton Ohio DUI judges do not have the discretion to go below the mandatory minimum sentences set by Ohio statute in a Hamilton DUI case.
