The charge makes it illegal to operate a motor vehicle while impaired by alcohol or drugs, or operating a motor vehicle with a blood alcohol content (BAC) of 0.08% or higher, also called a per se Dayton DUI violation. In addition, Ohio law has a higher tier drinking and driving charge, also called a super DUI, where a Dayton DUI driver has an extreme BAC concentration of 0.17% or more.
In Dayton, DUI is considered an extremely serious charge that carries extremely serious penalties if the driver is convicted. How serious? For starters, a Dayton DUI carries mandatory jail time up to a maximum of 180 days, even for a first-time DUI offender. It also carries a mandatory Ohio license suspension anywhere from six months up to three years and a mandatory fine that can go over a $1000. In addition, Dayton DUI courts can require you to complete a chemical dependency treatment program and place DUI license plates onto your vehicle. Dayton DUI courts can also require you to install a device on your car called an ignition interlock. This device forces you to provide an alcohol-free breath sample every time you start your car.
Again, these are among the potential penalties for first time Dayton DUI cases. For individuals who are on a second DUI, third DUI or felony DUI, the penalties are much more serious—more mandatory jail time, higher fines, longer license suspensions and many collateral consequences. For a felony DUI in Dayton, Ohio, defendants can be sentenced to multiple years in prison. Unfortunately, Ohio judges do not have the discretion to go below the mandatory minimum sentences in a Dayton DUI case. Fortunately, the penalties discussed above only apply to drivers who are convicted of DUI.
